Terms of Service
Effective date: June 16, 2026 · Last updated: June 16, 2026
These Terms of Service ("Terms") govern access to and use of the Voiceie website, demo requests, onboarding, subscriptions, and AI receptionist services (collectively, the "Service") provided by Pay Host LLC, a New Mexico limited liability company registered since 2023 ("Pay Host," "we," "us," or "our").
By accessing the website, requesting a demo, creating an account, or using Voiceie, you agree to these Terms and our Privacy Policy and Refund Policy. If you are accepting on behalf of a business, you represent that you have authority to bind that business. If you do not agree, do not use the Service.
The Service is offered for commercial business use only. These Terms are intended to allocate operational, billing, compliance, and customer-communication responsibilities between Pay Host and the business customer using Voiceie.
1. The Service
Voiceie is a business-to-business AI receptionist platform designed to help service businesses answer phone calls and, on eligible plans, text messages; capture intake information; route urgent calls; book or reschedule appointments; generate transcripts and summaries; and transfer calls according to rules you configure.
The Service is provided on a software-as-a-service basis. We may update features, integrations, pricing, usage limits, or supported workflows from time to time. We will use commercially reasonable efforts to avoid materially reducing core functionality during a paid subscription term, except where changes are required for legal, security, or operational reasons.
2. Eligibility and Account Registration
The Service is intended for businesses and authorized business representatives. You must provide accurate account information and keep it current. You are responsible for all activity under your account and for maintaining the confidentiality of login credentials. Notify us promptly at contact@voiceie.com if you suspect unauthorized access.
3. Subscriptions, Billing, and Payment
3.1 Plans and pricing
Current published plans include Voiceie Core and Voiceie Pro, billed monthly or annually as selected at checkout or in your order form. Published pricing, included usage, and feature differences are described on our website and may be updated for new subscriptions or renewals after reasonable notice.
As of the effective date above, published pricing includes:
- Voiceie Core: $299 per month on monthly billing, or $229 per month billed annually ($2,748 per year); includes 300 call minutes per month; additional minutes billed at $0.97 per minute unless otherwise stated in your order.
- Voiceie Pro: $449 per month on monthly billing, or $349 per month billed annually ($4,188 per year); includes 1,000 call minutes per month; additional minutes billed at $0.50 per minute unless otherwise stated in your order.
Your checkout page, invoice, written order confirmation, or signed order form may include additional or different details such as plan tier, billing period, taxes, promotional pricing, add-ons, or usage limits. If there is a conflict, the more specific accepted order terms control for that transaction.
3.2 Authorization to charge
By subscribing, you authorize Pay Host and our payment processor, Stripe, to charge your selected payment method for recurring subscription fees, applicable taxes, setup or add-on fees shown at checkout, and authorized usage-based or overage charges. You agree to keep valid payment information on file and authorize us to update payment credentials through card network or payment processor account updater services where available.
Usage records generated by Voiceie and its providers, including call duration, message activity, and integration usage, are the billing source of truth unless we determine there was a clear technical error. Overage charges are earned when usage occurs and are non-refundable once incurred except for verified billing errors.
3.3 Renewals and cancellation
Subscriptions renew automatically at the end of each billing period unless canceled before renewal. You may cancel before the next renewal date through your account billing settings, Stripe customer portal if available, or by contacting contact@voiceie.com from the email address associated with your account. Cancellation stops future renewals; it does not entitle you to a refund for the current billing period except as stated in our Refund Policy.
3.4 Taxes
Fees are exclusive of applicable taxes unless stated otherwise. You are responsible for taxes associated with your purchase, excluding taxes based on our net income.
3.5 Late or failed payment
If payment fails, we may retry charges, suspend access, or terminate the account after reasonable notice. You remain responsible for unpaid amounts.
3.6 Billing disputes and chargebacks
You must notify us of suspected billing errors within fourteen (14) days of the charge. Undisputed amounts remain due and payable. If you initiate a chargeback for a valid charge without first giving us a reasonable opportunity to resolve the issue, we may suspend or terminate the Service, dispute the chargeback with records of subscription authorization, onboarding, service delivery, usage, and account communications, and recover chargeback fees where permitted by law.
4. Onboarding and Customer Responsibilities
You agree to:
- Provide accurate business information, service areas, hours, pricing guidance, emergency rules, on-call contacts, and integration credentials needed for setup;
- Review and approve call flows, scripts, and routing logic before go-live and keep them updated;
- Maintain working phone numbers, calendars, CRM connections, and staff contacts used by Voiceie;
- Respond to urgent operational issues on your side, including failed transfers, unavailable on-call staff, and incorrect business data;
- Maintain human backup, on-call coverage, and escalation processes for urgent, emergency, regulated, or high-value communications;
- Ensure your use of Voiceie complies with applicable laws, industry rules, carrier requirements, and platform terms for any connected third-party services.
You acknowledge that Voiceie operates based on the instructions and data you provide. We are not responsible for missed bookings, incorrect routing, failed transfers, unhandled messages, lost revenue, customer dissatisfaction, or operational issues caused by outdated, incomplete, unavailable, or inaccurate configuration on your account or by your staff, vendors, phone lines, calendars, CRMs, or other systems.
Onboarding, account provisioning, configuration work, and activation preparation are part of Service delivery. Your delay or failure to provide required information, approvals, credentials, or staff availability does not pause billing or create a refund right unless we agree in writing.
5. Call Recording, SMS, and Compliance
You are solely responsible for determining whether your use of call recording, automated answering, AI-generated responses, SMS messaging, appointment booking, and lead capture complies with federal, state, local, and industry-specific laws applicable to your business, including notice, consent, do-not-call, telemarketing, call recording, consumer protection, AI disclosure, emergency-service, TCPA, CTIA, carrier, and 10DLC registration requirements.
Where required, you must provide appropriate disclosures to callers and texters, obtain required consents, honor opt-out requests, maintain your own privacy notices describing how End Contacts' information is handled, and avoid sending marketing, promotional, or automated messages without legally sufficient consent. Pay Host does not provide legal advice, does not act as your compliance officer, and does not guarantee compliance on your behalf.
6. Acceptable Use
You may not use the Service to:
- Violate law or third-party rights;
- Transmit unlawful, harassing, deceptive, fraudulent, or abusive content;
- Impersonate another person or business without authorization;
- Send spam, unlawful robocalls, or unauthorized marketing messages;
- Operate unlawful lead generation, debt collection, telemarketing, medical, legal, financial, insurance, or other regulated workflows without all required licenses, consents, disclosures, and human oversight;
- Interfere with or disrupt the Service, networks, or security controls;
- Reverse engineer, scrape, probe, or attempt to access non-public areas except as permitted by law;
- Resell, sublicense, or provide the Service to third parties except as expressly authorized in writing;
- Use the Service as an emergency dispatch, 911, alarm monitoring, medical triage, life-safety, or other high-risk system where failure could cause death, personal injury, severe property damage, environmental harm, or legal rights to be lost.
We may investigate suspected violations and suspend or terminate access where we reasonably believe misuse, fraud, or legal risk exists.
7. Third-Party Services and Integrations
The Service may rely on or integrate with third-party providers, including telephony carriers, speech providers, cloud infrastructure vendors, CRMs, calendars, and Stripe for payments. Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party outages, API changes, data handling practices, or service limitations outside our control.
8. Intellectual Property
Pay Host and its licensors own the Service, website, software, documentation, branding, and all related intellectual property. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
You retain ownership of your business content, configuration, and data you submit. You grant Pay Host a non-exclusive, worldwide license to host, process, transmit, display, and use your content solely to provide, maintain, secure, support, and improve the Service and as otherwise described in our Privacy Policy.
You may not use our trademarks, logos, or branding without prior written consent.
9. Confidentiality
Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and will not disclose it except to personnel, contractors, or advisors who need to know it and are bound by confidentiality obligations, or as required by law. Confidentiality obligations do not apply to information that is publicly available without breach, independently developed, or rightfully received from a third party without restriction.
10. Service Availability and Support
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, carrier issues, integration failures, internet outages, AI provider limitations, force majeure events, or factors outside our reasonable control. Support is provided through reasonable commercial channels, primarily email at contact@voiceie.com, during normal business hours unless otherwise stated in your plan or order form. Unless expressly agreed in writing, we do not provide a service-level agreement, service credits, or guaranteed response time.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAY HOST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that Voiceie will answer every call, correctly classify every emergency, book every appointment, prevent all missed leads, generate revenue, comply with laws specific to your business, or replace the judgment of trained human staff. AI-generated responses may be incomplete, delayed, or inaccurate. Voiceie is not a 911 service, emergency dispatch service, alarm monitoring service, or life-safety system. You remain responsible for monitoring critical communications and maintaining appropriate human backup for urgent or high-risk situations.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAY HOST AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAY HOST'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PAY HOST FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You will defend, indemnify, and hold harmless Pay Host and its owners, members, managers, employees, contractors, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content, configuration, or instructions; (b) your business communications handled through Voiceie; (c) your violation of these Terms or applicable law; (d) your failure to provide required notices or obtain required consents; or (e) disputes between you and your customers, callers, or End Contacts.
14. Suspension and Termination
You may stop using the Service at any time and cancel as described above. We may suspend or terminate access immediately if you breach these Terms, fail to pay amounts due, create legal or security risk, or if continued provision becomes impractical due to law, carrier action, or third-party restriction. Upon termination, your right to use the Service ends, but sections that by nature should survive will survive, including payment obligations, confidentiality, disclaimers, limitation of liability, indemnification, and governing law.
15. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Material changes to paid subscriptions will apply no earlier than the next renewal unless required sooner by law or for security reasons. Continued use after the effective date constitutes acceptance.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. Except where prohibited, the parties agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Mexico, and each party submits to personal jurisdiction in those courts.
Before filing a claim, the parties agree to attempt in good faith to resolve the dispute by contacting contact@voiceie.com and allowing thirty (30) days for discussion.
To the maximum extent permitted by law, claims must be brought on an individual basis and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. Any claim must be filed within one (1) year after it arose, unless a longer period is required by law.
17. General
These Terms, together with the Privacy Policy, Refund Policy, and any order form or checkout terms accepted by you, constitute the entire agreement regarding the Service. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
